Who Needs an LMIA

A Labour Market Impact Assessment (LMIA) is a document that an employer in Canada may need to get before hiring a foreign worker 1. Most employers need an LMIA before they can hire a temporary foreign worker 1. The LMIA application must be submitted by an employer that meets the following requirements: operates a legitimate and active business, offers goods or services to the general public, has the financial means to pay a salary to a foreign worker, can demonstrate a genuine need for a foreign worker to fill a specific position, and has not engaged in layoffs of any employees within the past 12 months preceding the LMIA application 1. However, some jobs do not need an LMIA. For instance, if you have been working full-time for the employer on your work permit for at least 1 year (or an equal amount of part-time work), your employer doesn’t need an LMIA to support your job offer 2.
